Scope and order of application
These terms apply to browsing the website and using its calculators, catalogues, forms and public content. Voluntary access and use confers user status and requires compliance with these rules.
Taking out a subscription, sensor, installation, integration or professional service is also governed by the accepted offer, order, contract or specific terms. In the event of conflict, the specific terms prevail for the contracted service, without prejudice to mandatory law.
Informational purpose and no binding offer
The website presents solutions, features, examples, indicative pricing and contact channels. Unless expressly identified as an offer and accepted by AgroMind, its content is not a contractual offer, availability guarantee or commitment to results. Sending a form or message does not itself create a contract.
Accounts and platform access
When an account is created at app.agromind.es, users must provide accurate information, protect credentials and restrict access to authorised people. The account organisation is responsible for managing its users and must promptly report unauthorised use. Specific terms displayed or accepted during registration supplement this document.
- Personal credentials may not be shared outside the authorised organisation.
- Available functions depend on the plan, configuration, connectivity, compatible equipment and assigned permissions.
- AgroMind may take reasonable measures to protect accounts, data and infrastructure where abuse or security risk is suspected.
Plans, prices and contracting
Amounts marked “from” and results from commercial calculators are initial estimates. They do not necessarily include configuration, installation, travel, connectivity, maintenance, accessories or other undescribed items. Before contracting, the proposal will itemise the applicable price, taxes, additional charges, billing frequency, term and payment method.
Free or trial plans may have usage, resolution, history, area or feature limits. Paid plans, renewals, changes and cancellations are governed by the accepted proposal or order. No charge is made merely for submitting the public form.
Equipment, sensors and installation
Compatibility, scope, components, timing, installation, connectivity, warranty and maintenance will be detailed in the proposal or order. Website photographs and specifications are informational and may change due to availability or technical development without reducing agreed performance. Mandatory statutory warranties always apply.
Permitted use and conduct
Users must use the website and services lawfully, diligently and for their intended purpose.
- Do not attempt unauthorised access, penetration testing, unlawful reverse engineering, mass extraction or service interference.
- Do not introduce malware, abusive automation or content infringing third-party rights.
- Do not use recommendations or data for unlawful or misleading activities or in ways that endanger people, animals, facilities or the environment.
- Keep data, equipment and permissions current so measurements and integrations can operate reliably.
Customer-provided data
Customers retain ownership and control of plot, facility, sensor, crop, livestock and operational data they provide. They grant AgroMind a non-exclusive, limited authorisation for the period needed to host, process and transmit that data and deliver the contracted functions.
Customers warrant that they may provide the data and have informed or obtained authorisation from third parties where personal data is involved. Export, retention and deletion are governed by the plan, contract and applicable law. Where AgroMind acts as processor, an Article 28 GDPR data processing agreement will be entered into.
Intellectual and industrial property
AgroMind software, models, designs, trademarks, text, images, databases, documentation and other materials are protected and owned by AgroMind or its licensors. Users receive only the limited right of access and use needed for the contracted purpose. Copying, modifying, distributing, reselling or exploiting these elements is prohibited unless expressly authorised or permitted by law.
Predictive models and recommendations
AgroMind is a decision-support tool. Alerts, indices, predictions and recommendations depend on the quality, representativeness, availability and timeliness of data and on changing weather, agronomic, livestock and technical conditions.
Results do not replace inspection, professional diagnosis, manufacturer instructions, applicable law or the judgement of the responsible person. Before a material action, users must verify the information and apply professional judgement. AgroMind does not guarantee yields, savings or the absence of incidents.
Calculators and environmental indicators
Carbon footprint, water footprint, pricing and other calculators provide indicative estimates based on user input and general factors. They are not an audit, certification, official environmental statement, tax advice or expert report. Verifiable results require complete data and a methodology validated by the appropriate professional or body.
Kit Digital, grants and public funding
Information about public programmes is general and may become outdated. Eligibility, amounts, deadlines and awards depend solely on the issuing body and official rules. AgroMind does not guarantee funding and does not replace administrative, tax or legal advice. Official publications always prevail.
Links, integrations and third parties
The website and platform may link to or integrate with third-party services such as WhatsApp, satellite, weather, payment, API or public programme services. They may have their own terms, availability and policies. AgroMind does not control their content or accept responsibility for outages or changes attributable solely to them, without limiting AgroMind’s own contractual duties.
Availability, maintenance and support
AgroMind seeks to keep services available and secure, but maintenance, updates, communication incidents, third-party failures or events beyond reasonable control may occur. Any committed service level, support hours or response time will appear in the applicable plan or contract. Technical changes needed for security, compatibility or service improvement may be made.
Privacy and communications
Personal data processing is governed by the Privacy Policy. Marketing will only be sent where legally justified and will always include an easy opt-out. Contract acceptance, privacy information and any marketing consent are handled separately.
Suspension and termination
AgroMind may temporarily suspend access where needed to protect security, prevent unlawful use, remedy a material breach or comply with law. Where possible, prior notice and a reasonable opportunity to remedy will be provided. Termination, its effect on data and possible exports are governed by the contract and applicable law.
Liability
Each party is liable under applicable law and contract for direct damage caused by its breach. AgroMind is not responsible for decisions taken in disregard of warnings, manifestly incorrect data, third-party installations, unauthorised use or circumstances beyond its reasonable control.
Nothing in these terms excludes or limits liability for fraud, gross negligence, personal injury or non-waivable rights. Any financial cap for professional services will be clearly stated in the relevant proposal or contract and reflect the nature of the service.
Force majeure
Neither party is liable for delay or failure caused by unforeseeable or unavoidable events beyond reasonable control, including natural disasters, general communication or power outages, government action, general labour disputes or widespread failure of essential providers. The affected party will seek to notify the other and reduce the impact.
Changes
AgroMind may update these terms for legal, technical or service changes. New versions apply to future browsing from publication. Material changes affecting a contracted service will be notified with reasonable notice and will not retroactively alter essential agreed terms unless required by law or agreed by the parties.
Law, jurisdiction and contact
These terms are governed by Spanish law. If the user acts as a consumer, any dispute will be resolved before the bodies determined by mandatory law, including the courts of the consumer's place of residence where applicable. In relationships between professionals or businesses, unless a valid specific agreement provides otherwise, the parties submit to the courts of Zaragoza.
Legal enquiries may be sent to legal@agromind.es. Commercial or technical matters may be sent to info@agromind.es or the channel stated in the proposal.
