Scope
This policy applies to processing through agromind.es, its forms, and communications initiated with AgroMind by email, phone or WhatsApp. Use of app.agromind.es may involve additional processing, which will be explained during registration, within the contractual relationship or in the applicable data processing agreement.
Data processed and source
Data mainly comes from you, when you complete a form, request a demo, ask for a quote or communicate with us. Technical data may also be generated while you browse.
- Identification and contact data: name, surname, email, phone and company, when provided.
- Professional and operational data: activity, crops, facilities, area, approximate location, equipment, needs and request content.
- Communication data: messages, emails, calls, meetings and follow-up of the request.
- Technical and security data: IP address, user agent, access date and time, server logs and events needed to prevent abuse, spam or incidents.
- Contract and billing data where a commercial relationship exists.
Purposes and legal bases
Each processing operation has a specific purpose and legal basis:
- Responding to enquiries, information requests, demos and quotes: pre-contractual steps taken at the request of the data subject (Art. 6(1)(b) GDPR).
- Preparing proposals, arranging meetings and managing a commercial or contractual relationship: pre-contractual steps or performance of a contract (Art. 6(1)(b) GDPR).
- Protecting the website, preventing fraud, spam and unauthorised access, and defending claims: legitimate interest in service security and continuity (Art. 6(1)(f) GDPR). You may object on grounds relating to your particular situation.
- Meeting tax, accounting and commercial duties and valid authority requests: legal obligation (Art. 6(1)(c) GDPR).
- Sending marketing unrelated to your request: only with specific consent (Art. 6(1)(a) GDPR) or another applicable legal authorisation. The contact form does not subscribe you to promotional messages by itself.
Required data, accuracy and minimisation
Fields marked with an asterisk are needed to identify and answer the request. If you do not provide them, we may be unable to respond. The phone field is optional in the public form.
You must provide accurate, current data that belongs to you, and avoid including sensitive information or unnecessary third-party data. If you act for an organisation, you state that you are authorised to provide the contact data used.
Recipients and providers
We do not sell personal data. Providers strictly needed to deliver and protect the service may access it under the data protection conditions that apply.
- FormSubmit, used to receive and forward data submitted through the website form by email.
- Hosting, infrastructure, email, support, security and internal management providers.
- WhatsApp and Meta when you voluntarily choose that channel; their service is also governed by their own terms and policies.
- Professional advisers and providers involved in a proposal where necessary and legally justified.
- Public authorities, courts and law enforcement where required by law or a valid request.
International transfers
Some technology providers, particularly form, email or messaging services, may process data outside the European Economic Area. AgroMind will only use such services where a valid mechanism exists, such as an adequacy decision, Standard Contractual Clauses or another safeguard allowed under Articles 45 to 49 GDPR.
You may request information about applicable safeguards at legal@agromind.es. Before adding new providers, their location and transfer mechanism will be reviewed.
Retention periods
Data is kept only for as long as necessary for the purpose for which it was collected and then blocked for the applicable limitation periods.
- Enquiries, demos and quotes that do not lead to a contract: up to 24 months from the last relevant interaction, unless you request erasure earlier or specific evidence needs to be kept.
- Contractual relationships: for their duration and afterwards for applicable tax, accounting, commercial and liability periods.
- Marketing communications based on consent: until you withdraw consent; the minimum information needed to prove the unsubscription or objection will be kept.
- Technical and security logs: for a limited, proportionate period, normally no longer than 12 months unless an incident requires longer retention.
Your rights
You may request access, rectification, erasure, objection, restriction and portability where applicable. You may also withdraw consent at any time without affecting prior lawful processing.
To exercise your rights, email legal@agromind.es and state the right requested and enough information to identify you. Additional documentation will only be requested where needed to verify identity. We generally respond within one month.
If you believe your data has not been handled properly, you may complain to the Spanish Data Protection Agency.
Automated decisions and predictive models
The public website does not make decisions based solely on automated processing that produce legal or similarly significant effects. AgroMind calculators and models provide estimates, alerts or decision-support recommendations; the final decision always remains with the user or responsible professional. If a future service changes this, the information required by the GDPR will be provided beforehand.
Security and confidentiality
We apply risk-appropriate technical and organisational measures to protect confidentiality, integrity, availability and resilience, including encryption in transit, access controls, permission management and incident review. No internet-connected system can be considered completely invulnerable.
Minors
The website and services are intended for professionals, businesses and people working in the primary sector. We do not intentionally seek data from minors. Children under 14 must not send data without authorisation from a parent or legal guardian.
Third-party sites and channels
Links to WhatsApp, LinkedIn, public bodies and other sites lead to services outside AgroMind. Those third parties may process data as independent controllers under their own policies. We recommend reviewing them before providing information.
Changes and contact
We will update this policy when processing, providers or legal requirements change. The version published here, with its update date, is the current one. Material changes will be communicated by appropriate means where required.
